The Law Firm's Practice and Background

Bushnell & Caplan LLP, formerly Bushnell, Caplan & Fielding, LLP, has been practicing law in San Francisco since 1971. In December, 2011, David Fielding separated from the firm to engage in his own law practice with an emphasis in providing mediation services. The firm has engaged in extensive civil and criminal litigation, both at the trial and appellate levels. We have tried in excess of 100 cases, mostly in the Bay Area, and have been the law firm of record in over 75 published appellate opinions. To read about several of these opinions and cases please see our noteworthy cases section.

The firm's practice currently focuses on representing plaintiffs in cases involving labor and employment law (with an emphasis on wrongful discharge, civil rights and sexual harassment), personal injury law; and consumer protection (consumer fraud and consumer class actions). One partner, Roderick Bushnell, also has experience in providing mediation services, and employer consulting and litigation defense.

The firm has been lead counsel or co-lead counsel in litigation involving shareholder derivative actions, consumer class actions, unfair competition and false advertising cases, employment rights class actions, labor and employment cases and environmental lawsuits brought on behalf of the general public. These cases are in addition to representing innumerable civil plaintiffs and criminal defendants through the years.

The firm has represented a number of public-interest non-profit organizations in litigation, including: The Natural Resources Defense Council, The Environmental Law Foundation, Fort Mason Foundation, Sweatshop Watch, The Asian Law Caucus, Global Exchange, Bay Area Video Coalition, Bluewater Network and Bread & Roses.

The Martindale-Hubbell Law Directory has been rating lawyers with respect to legal ability and general ethical standards for over 100 years.
